What Is a DWI in North Carolina?

Under North Carolina law, it is illegal to operate a motor vehicle with a blood alcohol concentration (BAC) of 0.08% or higher, or to be appreciably impaired. Drivers convicted of DWI face both criminal penalties and administrative consequences that can impact their freedom, finances, and ability to work.

DWI Penalties in North Carolina

North Carolina uses seven levels of DWI sentencing, based on factors such as your BAC, prior offenses, and whether there were aggravating circumstances (like driving on a suspended license or having a BAC of 0.15% or more).

DWI Sentencing Levels and Penalties:

  • Aggravated Level I – Up to 3 years in jail and $10,000 in fines
  • Level I – Up to 2 years in jail and $4,000 in fines
  • Level II – Up to 1 year in jail and $2,000 in fines
  • Level III – Up to 6 months in jail and $1,000 in fines
  • Level IV – Up to 120 days in jail and $500 in fines
  • Level V – Up to 70 days in jail and $200 in fines

IIn some cases, a fourth DWI offense can be charged as a felony, which carries even harsher penalties.

License Revocation & Limited Driving Privileges

If convicted of DWI, your driver’s license can be revoked for at least 12 months. However, you may qualify for limited driving privileges—allowing you to drive to work, school, medical appointments, or court-ordered programs.

We will guide you through the eligibility process and help you pursue these privileges, so you can maintain your responsibilities while your case is resolved.

We Fight for Dismissal or Reduction of Charges

Our legal team carefully examines every detail of your arrest, including:

  • Whether the traffic stop was lawful
  • How sobriety tests were administered
  • If your constitutional rights were violated
  • Any errors in chemical or breath test procedures

If law enforcement acted improperly, we will work to suppress the evidence—which can often lead to charges being reduced or dismissed entirely.
